Welcome to Masala Recipe, operated by Veerappa Software Solutions and Services, Amravati, Maharashtra (GSTIN: 27AYLPM1861G1Z8) (referred to as the "Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the masalarecipe.in website and the services provided (collectively, the "Service"). By signing up, signing in, creating an account, or using the Service, you (referred to as the "User", "Purchaser", "Manufacturer", or "you") acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. This agreement is an electronic contract formed under the Information Technology Act, 2000 (as amended) and the Indian Contract Act, 1872, and is legally binding and enforceable. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and that all registration information you submit is truthful and accurate. If we discover that an account has been created by a person under 18, we reserve the right to terminate it immediately without notice. If you are using the Service on behalf of a business entity, you further represent that you have the authority to bind that entity to these Terms.

2. Description of Service

We provide a digital platform where users can purchase, access, and download commercial-grade spice blend formulas ("Formulas"), utilize dynamic cost calculators, and generate production batch PDFs (for subscribed users). The Service also includes optional monthly subscription plans that provide varying levels of batch management, PDF generation, and AI credit allowances, as well as an AI Formulation Assistant and a free AI-generated recipe blog.

3. Intellectual Property and Commercial License

When you purchase a Formula from us, you are granted a non-exclusive, worldwide, royalty-free license for Commercial Manufacturing.

You are permitted to:

  • Manufacture, package, and sell physical spice blends and food products using the purchased Formula.
  • Modify the Formula to suit your specific manufacturing or taste requirements.

You are strictly prohibited from:

  • Reselling, sharing, publishing, sublicensing, or distributing the digital Formula (or any modified version of the formula) to any third party.
  • Using the Formulas to create a competing digital formula service.
  • Reverse engineering, decompiling, or disassembling any part of the Service or its underlying technology.
  • Using automated tools, scripts, bots, or scrapers to extract formula data, pricing, content, or any other information from the Service.

Commercial Testing & Market Readiness:

While the Company provides formulas derived from active commercial environments, the extent of historical market validation varies by variant. Premium variants are market-validated formulations with a history of use in retail and wholesale operations. However, how these proprietary formulas were validated, specific historical deployment environments, supplier data, lab reports, and commercial track records are strictly confidential trade secrets and will not be shared or disclosed under any circumstances. Furthermore, the identities of all Users who purchase our formulas are also kept strictly confidential to protect their business interests. By purchasing a formula, the Purchaser explicitly acknowledges and agrees to this absolute non-disclosure policy. If you require verifiable proof of testing, market reports, or historical data, you must refrain from purchasing any formula from our Service. Economy variants are optimized for cost-efficiency in B2B environments and may have a limited B2C market history. Regardless of a variant's history or designation, the Purchaser assumes full and sole responsibility for conducting their own quality assurance, shelf-life testing, legal compliance, and market validation before scaling commercial production.

Taste Profile & Brand Comparability:

The formulas provided are our unique, proprietary creations. The final taste profile, aroma, and color of the product cannot and should not be compared with or benchmarked against other well-known commercial brands with similar masala names. We do not research, reverse-engineer, or formulate our blends to match or imitate any specific manufacturer's product. Taste is highly subjective, and the final sensory profile of your manufactured product depends entirely on your raw ingredient quality, sourcing region, and processing methods. We make no guarantees that the formula will align with your subjective expectations or regional flavor preferences.

Ownership:

All digital formulas, website software, preparation videos, visual styles, content, trademarks, and all other intellectual property associated with the Service remain the exclusive property of Veerappa Software Solutions and Services and are protected under applicable copyright, trademark, and intellectual property laws. Your purchase grants you a limited license to use the Formula for physical manufacturing only, as described above. No ownership, title, or other intellectual property rights in the Formula are transferred to you.

4. Disclaimer of Warranties

The Service and all Formulas are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that: (a) the Formulas will meet your specific requirements, commercial objectives, or subjective taste expectations; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the use of the Formulas will be accurate, complete, or commercially successful; or (d) any defects in the Service will be corrected. You acknowledge that you are purchasing Formulas based on your own independent evaluation and judgment, and that you have not relied on any representation or warranty not expressly set forth in these Terms.

5. Limitation of Liability and Food Safety

We provide commercial-grade formulas, not food safety compliance. By using our Formulas, you acknowledge and agree that:

  • You are solely responsible for all aspects of physical manufacturing, including but not limited to hygiene, sanitation, allergen cross-contamination, and shelf-life testing.
  • You are solely responsible for complying with all local, national, and international food safety laws and regulations (e.g., FSSAI in India, FDA in the USA, EFSA in Europe, GMP, HACCP).
  • Veerappa Software Solutions and Services shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, health issues, food safety penalties, regulatory fines, or legal claims arising from the physical products you manufacture using our Formulas, howsoever caused and under any theory of liability (whether in contract, tort, strict liability, or otherwise).
  • You acknowledge that the Manufacturing Guidelines & Best Practices provided with each formula are for informational and educational purposes only, and you assume full responsibility for validating and implementing appropriate manufacturing controls in your facility.
  • No Transfer of Liability: Any commercial validations, shelf-life estimates, or testing statuses associated with our formulas do not absolve you of this responsibility. The quality of your raw materials, hygiene practices, and manufacturing environment remain entirely your responsibility.

Aggregate Liability Cap:

To the maximum extent permitted by law, in no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you actually paid to us for the specific Formula or subscription giving rise to the claim. This limitation applies to all causes of action in the aggregate, whether in contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless Veerappa Software Solutions and Services, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees and legal costs) arising from or relating to:

  • Your use of the Formulas in physical manufacturing, including any product liability, food safety, or regulatory claims relating to products you manufacture, package, or distribute.
  • Your violation of any applicable local, national, or international law or regulation.
  • Your breach of any provision of these Terms.
  • Any claim by a third party arising from your use of the Service or the Formulas, including claims relating to allergic reactions, contamination, mislabeling, or regulatory non-compliance.

This indemnification obligation shall survive the termination or expiration of your account and these Terms.

7. Approximate Making Costs & Margins

The "Approximate Making Cost" displayed for any formula is a raw estimate based solely on general ingredient proportions. It explicitly excludes all operational and overhead costs, including but not limited to: roasting, grinding, labour, packaging, storage, logistics, marketing, and applicable taxes. The actual final making cost will vary significantly depending on current market rates and how cost-effectively you procure your raw materials. We do not guarantee any specific profit margins, production costs, or financial returns.

Building Commercial Success: A well-formulated product, an excellent taste profile, and premium raw materials paired with attractive packaging build a solid foundation for long-term viability, but do not guarantee immediate commercial success. Reaching your target audience requires sustained and targeted marketing efforts on your part. We provide the formulation expertise; market penetration, brand building, distribution, and customer acquisition remain entirely your responsibility.

8. Shelf-Life & Storage Conditions

We provide a generic shelf-life estimate (e.g., 7 months) for our formulations based on ideal storage conditions. This is strictly a theoretical guideline. To achieve maximum shelf-life, spice blends must be STORED IN A HYGIENIC PLACE AWAY FROM MOISTURE, HUMIDITY, INSECTS, PESTS, STRONG ODOURS, SUNLIGHT, AND DUST. You, as the manufacturer, are solely responsible for conducting formal lab testing to determine the actual shelf-life of your final physical product based on your specific manufacturing and packaging environment. The actual shelf-life will vary dramatically based on the initial moisture content of your procured raw ingredients, the freshness of your cooking oils (for oil-atomized blends), and your packaging's sealing mechanisms. We accept no liability for product spoilage or shelf-life failures.

9. Cancellation and Refund Policy

Due to the digital and instantly accessible nature of our platform, all formula sales are final and subscriptions are non-refundable. 10. Shipping & Delivery Policy

We provide a digital Software-as-a-Service (SaaS). Absolutely no physical goods are shipped. Upon successful payment, all services and formulas are delivered instantly via cloud access. For complete details, please refer to our full Shipping & Delivery Policy.

11. Payments, Billing & Subscriptions

All payments are processed securely through our third-party payment provider (Razorpay). By providing payment information, you represent that you are authorized to use the payment method. We do not directly collect or store your credit card, debit card, or banking information. Prices for formula purchases are subject to change, but changes will not affect past purchases.

Subscription Plans:

  • Plans: We offer optional monthly subscription plans (Free, Starter, Pro) that provide varying levels of batch management, PDF generation, and AI credit allowances. Details of current plans and pricing are available on our Pricing page.
  • Auto-Renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged the then-current rate upon each renewal.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial billing periods.
  • Downgrade Effects:Upon cancellation or downgrade to a lower tier, features exceeding your new plan's limits (batch counts, AI credits, PDF generation) will become inaccessible. Your purchased formulas and existing data will be retained.
  • Price Changes:We may change subscription pricing with 30 days' written notice via email to your registered address. Continued use of the Service after the effective date constitutes acceptance of the new pricing. If you do not agree, you may cancel before the effective date.

Fair Usage Policy (FUP)

To ensure the stability and performance of our platform for all users, plans advertising "Unlimited" features (such as "Unlimited batches" on the Pro plan) are strictly subject to this Fair Usage Policy.

  • Soft Limit: Usage is restricted to a maximum of 1,000 batches per month. This limit is designed to easily accommodate any human-driven, manual business operation while strictly prohibiting automated script-based abuse, botting, or database scraping.
  • Enforcement: If your account exceeds this soft limit, we reserve the right to temporarily throttle your ability to create new batches, suspend your account, or require you to upgrade to a custom enterprise agreement.

12. Account Security & Termination

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to secure your account credentials.

Acceptable Use:

You agree not to: (a) use the Service for any unlawful purpose; (b) introduce malware, viruses, or harmful code; (c) impersonate any person or entity; (d) interfere with or disrupt the Service's infrastructure, servers, or networks; or (e) share your account credentials with any third party. Violation of these terms may result in immediate suspension or termination of your account.

Termination & Suspension:

We reserve the right, in our sole discretion, to suspend or terminate your account and refuse any and all current or future use of the Service if you: (a) violate any provision of these Terms, including the Intellectual Property restrictions in Section 3; (b) engage in fraudulent, abusive, or unlawful activity; (c) attempt to circumvent security measures, access controls, or usage limits of the Service; or (d) engage in conduct that we determine, in our sole discretion, to be harmful to other users, to us, or to our business interests. Upon termination for cause, your license to use any purchased Formulas shall be immediately revoked. We will not be liable to you or any third party for any suspension or termination of your access to the Service. Termination does not entitle you to any refund.

You may close your account at any time by contacting us at support@masalarecipe.in. Account closure is subject to any outstanding payment obligations.

13. AI Formulation Assistant

Our Service includes an AI Formulation Assistant powered by third-party LLM APIs (including but not limited to Mistral, Ollama, ChatGPT, Gemini, Claude, Deepseek, Qwen, Gemma, etc., via routing services like OpenRouter). By using this feature, you acknowledge that:

  • No Fixed Model: We do not guarantee the use of any specific underlying AI model, and the model may change at any time without notice.
  • Inaccuracy & Verification: AI-generated responses (including ingredient substitutions, scaling, nutritional estimates, descending ingredient lists, or cost optimizations) may be inaccurate, incomplete, or unsuitable for commercial production.
  • Your Responsibility: You must use your own professional judgment, conduct practical testing, and verify all AI-generated formulations before utilizing them in a production environment. Veerappa Software Solutions and Services is not liable for any losses or damages resulting from reliance on the AI Formulation Assistant.
  • Credit-Based Usage: AI queries consume credits allocated by your subscription plan. Unused credits do not roll over between billing cycles unless otherwise stated. Additional credits may be purchased where available under paid plans.

14. AI-Generated Recipes and Content

All recipe content provided on this platform (specifically under the https://masalarecipe.in/recipes path), including but not limited to instructions, ingredients, images, and videos, is generated by Artificial Intelligence. Such content may contain inaccuracies, omissions, or unsafe recommendations.

You are solely responsible for exercising independent judgment, verifying all culinary methods, and ensuring food safety before preparation, consumption, or commercial use. Veerappa Software Solutions and Services expressly disclaims all liability for any damages, health issues, or losses arising from your reliance on this AI-generated static content.

15. Disclaimer for Formula Preparation Videos

1. Illustrative Purpose Only:All preparation videos ("Videos") provided on this platform are produced solely for illustrative and informational purposes to offer a visual overview of the preparation process. They do not constitute an exhaustive or authoritative guide to manufacturing. The written "Preparation Steps" within your purchased formula always remain the final and authoritative reference.

2. AI-Generated Content & Potential Inaccuracies: These Videos are created using artificial intelligence (AI) generation tools. As such, the visuals—including equipment, facilities, machinery operations, and ingredient appearances—are computer-generated representations that may contain inaccuracies, visual errors, or unrealistic depictions. They may not perfectly reflect real-world production environments or standard operating procedures. In the event of any discrepancy between the Video and the written formula document, the written formula document shall strictly prevail.

3. No Representation of Quantities or Batch Sizes: The Videos do not depict actual quantities, proportions, ratios, or batch sizes required for production. All quantities and proportions visible on screen are purely illustrative. Users must refer exclusively to their purchased formula document for precise, actionable measurements and specifications.

4. Variation in Ingredients and Final Product: The appearance (colour, texture, size, shape) of raw spices, roasted/ground ingredients, and the final product may vary significantly depending on factors including, but not limited to: spice origin, variety, harvest season, and supplier; moisture content, age, and storage conditions; roasting duration, temperature, and equipment used; grinding coarseness and equipment type; ambient conditions and lighting/display screen calibration. The final product shown in the Videos is a visual approximation and should not be treated as an exact benchmark.

5. Food Safety and Regulatory Compliance: While the Videos may depict workers following general food safety practices, they do not serve as food safety training, FSSAI compliance guidance, or regulatory instructions. The purchaser/manufacturer is solely responsible for ensuring full compliance with all applicable local, national, and international food safety regulations (e.g., FSSAI, FDA, GMP, HACCP).

6. Not a Substitute for Professional Guidance: These Videos are not a replacement for professional food technology consultation, hands-on production training, or expert guidance. We strongly advise consulting qualified food technologists or regulatory consultants before initiating commercial production.

7. Intellectual Property: All Videos, including their content and visual style, are the intellectual property of Veerappa Software Solutions and Services and are protected under applicable copyright laws. Unauthorised reproduction, distribution, modification, or commercial use is strictly prohibited.

8. Limitation of Liability:Veerappa Software Solutions and Services shall not be held liable for any direct, indirect, incidental, or consequential damages, losses, or claims arising from the use of, reliance on, or interpretation of information presented in these Videos. This includes, without limitation, production failures, product quality issues, regulatory non-compliance, or financial losses. Use of these Videos is entirely at the user's own risk.

9. Accuracy and Updates: While every effort is made to provide a reasonably accurate depiction of the preparation process, Veerappa Software Solutions and Services reserves the right to modify, update, or remove any Video at any time without prior notice as formulas are revised.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government actions or orders, sanctions, embargoes, power failures, internet or telecommunications failures, cyberattacks, third-party service provider outages (including payment gateway and cloud hosting providers), labour disputes, or any other event constituting force majeure under applicable Indian law. In the event of a force majeure, our obligations will be suspended for the duration of the event, and we will make reasonable efforts to resume performance as soon as practicable.

17. Dispute Resolution & Governing Law

Informal Resolution:

Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service informally by contacting us at support@masalarecipe.in with a detailed written description of the dispute. We will attempt to resolve the dispute within 30 days of receiving your written notice. If the dispute is not resolved within this 30-day period, either party may pursue formal legal remedies.

Arbitration:

If the dispute is not resolved within this 30-day informal period, it shall be referred to and finally resolved by a sole arbitrator appointed in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Amravati, Maharashtra, India. The language of arbitration shall be English. The arbitrator's award shall be final and binding on both parties. If the dispute remains unresolved after arbitration, either party may pursue formal legal remedies in the courts specified below.

Governing Law & Jurisdiction:

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms that cannot be resolved through the informal process above will be subject to the exclusive jurisdiction of the courts located in Amravati, Maharashtra, India. You irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

18. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes (including but not limited to changes to pricing, refund policy, intellectual property terms, or liability provisions), we will provide at least 15 days' advance notice via email to your registered email address and/or a prominent banner on the Service. Your continued use of the Service after the effective date of any modification constitutes your binding acceptance of the revised Terms. If you do not agree with the revised Terms, your sole and exclusive remedy is to discontinue use of the Service and close your account before the effective date. Non-material changes (such as typographical corrections or clarifications) may be made without prior notice.

19. General Provisions

Severability:

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable while preserving the intent of the parties, and the remaining provisions of these Terms shall remain in full force and effect.

Entire Agreement:

These Terms, together with the Privacy Policy and any supplementary terms referenced herein, constitute the entire agreement between you and Veerappa Software Solutions and Services regarding the Service and supersede all prior agreements, representations, negotiations, and understandings, whether written or oral.

Waiver:

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any default shall not be deemed a continuing waiver or a waiver of any subsequent default or of any other provision.

Assignment:

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may freely assign these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of our assets. These Terms shall bind and inure to the benefit of the parties and their respective successors and permitted assigns.

Relationship of Parties:

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and Veerappa Software Solutions and Services.

Survival:

Sections 3 (Intellectual Property), 4 (Disclaimer of Warranties), 5 (Limitation of Liability), 6 (Indemnification), 17 (Dispute Resolution & Governing Law), and this Section 19 (General Provisions) shall survive any termination or expiration of these Terms.

Notices:

All notices under these Terms shall be in writing and shall be deemed given when: (a) delivered personally; or (b) sent by email to support@masalarecipe.in (for notices to us) or to your registered email address (for notices to you).

Third-Party Links:

The Service may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or availability of such external sites and do not endorse any products, services, or information offered by third parties.

Compliance with Applicable Laws:

You agree to comply with all applicable local, national, and international laws and regulations in connection with your use of the Service, including export control and sanctions laws.
